The regulations of the club and its clauses are those formulated by the Barcelona Sports Institute, for the municipal sports centers of the city. These clauses could be reviewed and modified in application of new criteria of the Barcelona Sports Institute.

1. FACILITIES
• The CEM Marítim is a municipally owned sports center managed by the Foundation Claror.
• It combines the benefits of a large sports center with those of a large thalassotherapy center (the only one in the city of Barcelona), offering a wide range of activities and services at affordable prices for everyone. With a privileged location, on the Paseo Marítim of Barcelona, ​​has a total area of ​​7.000 square meters, at the foot of the beach of Somorrostro, in Barceloneta.
• The Centre's regular opening hours are from 7.00 am to 22.30 pm from Monday to Friday; Saturday from 8.30 to 21.00, and Sunday and public holidays, from 09.00 to 16h
• The facility closes at 20 pm on January 5, June 23, December 24 and 31 (if working).
<br>•    Holidays that the club will be closed: 1 and 6 January, 1 May, 11 September, 25 and 26 December.  

    Sports areas close 30 minutes before the general closing of the center.

1.2. ENTRY AND EXIT PROCEDURE
They have access to the facilities of the Municipal Sports Center Marítim
a) Its subscribers.
b) People who participate in an organized activity.
c) People who make timely use of it by paying the entrance fee.
d) Groups that carry out an organized activity.
e) Public attending competitions.
f) Non-subscribers who contract welfare and health services

Access to the sports center is through a digital reader located at the main entrance of the center through the Charles Darwin Square, which gives way to cross the turnstile. The canceled port is for exclusive use for people with disabilities, the elderly or people with babies.
The access and exit of the users of the center is the one located exclusively in the main entrance, with the exception of the public and users of the pavilion (or other collectives that have a differential treatment), which must be accessed and left for independent access to the pavilion located also at Charles Darwin Square.

a) Subscriber to the Municipal Sports Center Marítim
• You must access the center through the digital reader located on any of the reception turnstiles. At the exit you must do the same operation, also regardless of any of the turnstiles.
• If the subscriber is registered in a certain time slot, the automatic access control authorizes him to enter and leave 30 minutes before and after his time slot.
• The use of the sports center for longer gives the right to a complementary bill.

b) Non-paid course participants who take part in guided activities
• You must access the center through the digital reader located on any of the reception turnstiles. At the exit you must do the same operation, also regardless of any of the turnstiles
• Children under the age of 12 must be accompanied.
• Entry to the center is allowed 30 minutes before the start of the activity and a maximum of 30 minutes after its opening hours.
• The dressing room and the space reserved for the contracted activity must be used.

c) People who make occasional use of the center.
             
    Punctual entries:
• They are sold whenever the capacity of the center allows it.
• When paying the corresponding ticket, the payment slip is received and must be carried at all times, together with the extract of the regulations for access and use of the sports center.
• The customer service staff will take the personal data of specific users for security reasons.
• Easy one-off entry entitles you to the free use of sports spaces and attendance at the guided activities included in the season ticket schedule. One-time entry to the club + spa includes all of the above plus access to the spa area.
• Once you leave the center, you cannot re-enter with the same ticket.

Rentals:
• Sports spaces, pavilion and activity rooms can be rented by subscribers and non-subscribers.
• The amount corresponding to the reserved space must be paid before entering the center.
• Entry to the center is allowed 30 minutes before the start of the activity and departure 30 minutes after the end.
• Only reserved space can be used.

d) Groups that carry out an organized activity
• The person in charge of the group has a proximity card to enter the whole group at once through the assigned door according to the type of activity and must always stay with their players / students.
• The person in charge of the group must deposit a personal identification document with photo and name at the reception and in return the locker room key is given to him. The personal card will be recovered when you return the locker room key, when the whole group leaves the center. Therefore, the key cannot be returned if any group member is still inside.
• Dressing rooms for designated groups should be used.
• In the case of teams competing, training is allowed to enter the center 15 minutes before the start of the activity and to leave 30 minutes after the end of the activity. On the day of the competition, entry is allowed 45 minutes before the start of the match and departure 30 minutes after the end.
• In the case of leagues organized by CEM Marítim, is allowed to enter the center 15 minutes before the start and must leave 30 minutes after the end.
• In all cases, the changing rooms must be locked, empty and in good condition.

e) Non-subscribers who contract welfare and health services
• When signing up for the service, you receive a ticket that identifies you.
• To access the center, the customer service staff will open the shift manually
• The user of this service cannot use the sports center. The time of use is necessary for the performance of the contracted health service.

1.3. ACCESS FOR SPECIAL COLLECTIBLES
a) Subscriber and users with reduced mobility
• The use of the lift is limited to people with reduced mobility. The Municipal Sports Center Marítim reserves the right to request the corresponding medical certificate when it deems it appropriate.
• To open the gate in front of the lift, use the special card (personal and non-transferable), both for entry and exit.

b) Regulations for children's subscribers under 12 years of age
Only facilities can be accessed in the following cases:
• Attendance to a course or directed activity as long as they are accompanied by an adult (tutor or technician of the Center)
• They must be accompanied by an adult family member (over the age of 18), who will be responsible for the minor. Whenever the center is used, both must necessarily remain in the same premises and / or in the swimming pool.
• For health reasons they cannot use the Thalassa Space or the Spa Marítim
• From the age of 7, they must use the dressing room that corresponds to them by sex.

2. REGULATION
The Municipal Sports Center Marítim has a regulation of use and a disciplinary regime that is applicable to all subscribers and users of the sports center, and to the external groups users of the center, as well as to all the people who access the center of sporadically by paying the entrance or punctual rent.
The interpretation and application or modification of this regulation is authorized by the competent body to follow the center.
The improper use of the facilities and the non-compliance of the regulations may be grounds for temporary or definitive expulsion. The definitive expulsion must be decided by the competent organ of the center's follow-up.  
 
2.1. ADMINISTRATIVE PROCESSES

a) Payment of fees
• Registration at the center will be formalized at the offices of the Municipal Sports Center and / or through the centre's website
• Receipts will be collected in the first 5 days of each month by bank receipt.
• In the event of a technical shutdown of a space or service due to maintenance and / or adaptation tasks, the user will not be entitled to any financial compensation.
• Fees will be reviewed once a year

b) Collection of unpaid fees
• The return of 2 consecutive direct debits will result in the loss of subscriber status. To recover it, you must pay the outstanding amounts, return costs and current registration fees.
• The manager has the power to place a surcharge  

c) Modification and cancellations
• Termination notifications and changes to bank details must be submitted before the 25th of the previous month. No refunds will be made if the cancellation is communicated later.
• The notification must be made in person, by fax or e-mail, in such a way that the request is registered with the signature of the applicant, to whom a confirmation of termination will be sent. None of these arrangements will be accepted by telephone.
• The change of fee motivated by the modification of the age section will be done automatically, with prior notification to the interested party.

d) Temporary leave
• The subscriber can request temporary leave for serious medical reasons or for work transfer after providing the supporting documentation.
• The period to enjoy the temporary leave will be a minimum of 2 months and a maximum of 12. If the leave is extended beyond 12 months, the supporting documentation must be renewed. In no case will a temporary withdrawal be recognized retroactively, or once it has generated an unpaid fee.

e) Medical Review and Physical Activity Initiation Questionnaire (QIAF)
• All new subscribers are entitled to a free sports medical check-up. On the other hand, they have the obligation to respond to the QIAF, and depending on the result, a sports medical check-up will be recommended before the start of physical activity. People over the age of 65 are also advised to undergo sports medical check-up.

f) Home returns and activities
• 50% of the amount will be refunded if the cancellation is communicated 10 days before the start of the activity and whenever it is due to illness or injury, with prior medical proof.

g) Reservation of spaces
• The person in charge of each area will be the person in charge of making available and reserving, where appropriate, the spaces intended for this purpose.

h) Suggestions and complaints:
• Users have a form to send any suggestions and complaints they deem appropriate to the management of the center, delivering it to the club reception. You will receive a response within a maximum of 15 days.

And others
• In the event of loss or deterioration of the proximity card, the application for a duplicate must be made to the centre's administration and the processing costs must be paid.
• In the event of loss of the key to the rental lockers, the amount must be paid to the administration.
• Suggestions and complaints: users have a form to send any suggestions and complaints they deem appropriate to the centre's management, by depositing it in the mailbox located at reception. You will receive a response within a maximum of 15 days.

3. GENERAL RULES

3.1 USER DEFINITION

Any individual or legal entity that makes use of the sports center, in any modality or discipline, either in a timely or prolonged manner and under any of the modalities of use, is understood by the user. Those who stay there will also be obliged to comply with this regulation to participate or witness an event that takes place there.
Subscriber
To acquire the subscriber status, the interested party must make the payment of the corresponding public price and provide the necessary personal data to the administration of the center, in order to process the registration.
Temporary or Temporary Users
To acquire this condition, you only have to pay the price of the expected entry or payment, and provide the name and official document that accredits you. Your personal data will be registered.
Users of Courses and / or Activities
To acquire the status of person enrolled in a course or activity, the application must be made and the person will be admitted depending on the places provided and by order of registration. When this can not be taken care of due to the lack of availability of places, it will be included in a waiting list in order of presentation, in order to access the course or activity at the moment of vacancy or extension of places , if that is possible.
Clubs, sports organizations and associations
These are legal entities that are legally registered in the Register of sports entities of the Generalitat and / or the Registry of Entities of the City Council of Barcelona.

Educational centers
Primary and secondary schools as well as special schools.

Cultural and / or social associations whose basic purpose is not physico-sports practice or the promotion of physical activity / sport, but which carry out physical and sports activities for their associates and associates, as well as informal groups of Users who request it. The authorization regime for the use of facilities will be the one planned for individual users, the managing entity may request the relationship of the people who will use it as members of this group.

3.2 USERS 'RIGHTS

a) Access to the facility and carry out the physical-sports activities at the established time and for the purpose for which it proves to be authorized.
b) Carry out the physical sports activities for which they have authorization.
c) Use the general access services of sports facilities.
d) Make claims, complaints and suggestions in relation to the service, following the established procedure and receive a response to the complaints or claims within 15 working days from the date of submission.
e) Request information on the operation of the center, as well as on sports programs and activities.
f) Exercising the rights of access, rectification and cancellation, in accordance with the provisions of Organic Law 15/1999, of 13 December, on the Protection of Personal Data.
g) Know the characteristics of the center. To this end, the CEM Marítim it will keep its own channels of information regarding its main features up to date.
h) Have a regulation of use in the information desk.

3.3 OBLIGATIONS OF GENERAL COMPLIANCE USERS

a) Make good use of the sports facilities, respect them and take care of them, as well as the furniture and any other element that has been installed.
b) Show the staff at the service of the facilities the authorization to use them, at the time of accessing them and at any time they request them.
c) Collaborate in the maintenance of the cleanliness of the installation and, to this end, make use of the bins and hygienic containers that exist.
d) Respect the operating hours.
e) Follow the instructions and instructions given by the service staff.
f) It is advisable to inform the personnel providing the service of any alterations in operation, defects or deficiencies in the operation of the installation.
g) Treat other users and the staff who work there with respect.
h) Respect and take care of the furniture, sports equipment and any other element of the center.
i) To pay punctually the public rates and / or prices established for each service or sports space and for each determined modality of use.
j) Carry out sports practice with the appropriate equipment and clothing for each type of activity and sports space in accordance with the specific regulations.
k) Leaving the installation when they have been warned of non-compliance with the regulations and refuse to rectify their conduct. To this end, the staff of the facility has the ability to expel any person or entity that does not comply with current regulations, general or specific, which is listed as not allowed or as mandatory for each space, in accordance with the present regulations of use and with the rest of the applicable legal regulations.
l) Provide the necessary data to acquire the status of user of the facilities or the status of person enrolled in a course or activity.
m) Images and sounds may not be recorded without the permission of the center management
n) Training cannot be done with other personnel.
o) You cannot smoke or eat.
p) Cannot be accessed with glass containers  
q) Not to use the mobile phone in the course of the directed activities. You can use your mobile phone in the fitness room as long as it is in vibration mode and the call is answered outside the sports area, so as not to disturb other users.

3.4 OF SPECIFIC COMPLIANCE FOR USERS BELONGING TO A GROUP

a) Designate, before the CEM Marítim and in writing, the person representing the entity for the purposes of drawing up the use plan for each season or period.
b) Subscribe and maintain the validity of the civil liability insurance policies that cover the activities to be carried out and the participants, both practitioners and the attending public, if applicable.
c) Communicate, with the necessary urgency, any incident arising from the activities that occur during their stay in the facility.
d) Use the installation for the purpose determined in the use agreement and according to the schedule provided in the use plan.
e) Respect the number of users in accordance with the communication made at the time of authorization.
f) Request express authorization from the CEM Marítim to modify the conditions of use of the two previous sections.
g) Adopt the necessary measures not to interfere with the schedules and activities of other users of the facilities

3.5 CONDITIONS OF ACCESS TO SPORTS FACILITIES

a) To access the installation, the user must identify himself / herself in the way established, and use the access control systems that exist in each center appropriately.
b) The opening and closing times of the facilities will be displayed at the reception.
c) Users must comply with the days and hours of opening and closing of the facilities and the days and periods of closure established annually.
d) In case of reaching the maximum capacity, the CEM Marítim reserves the right to close access to the installation, spaces or different activities.
e) One-off entrances only allow a single access to the installation; you will not be able to leave and re-enter once the space has been accessed.
f) In the group activities that come to do in the installations, the manager of the people participants will show to the person in charge of the control of access to the installation, his DNI or accrediting document, to be able to access in the changing rooms and other sports spaces. To obtain the keys to the spaces to be used, the person in charge must deposit an identification document, which will be returned to him once the keys have been handed in at the exit.

3.6 OTHER CONDITIONS OF ACCESS

a) The rest of the people that access to the installations will have to accredit by the means that consider sufficient his reason of entrance in the distinct spaces.
b) Users may not access the facilities with vehicles, skateboards, skates, bicycles or similar, or with any utensil or material that is not intended for the sport for which they are authorized, except those people who need it for reasons of reduced mobility in attention to their degree of disability.
c) Pets are not allowed, except guide dogs.

4. GENERAL USE OF SPACES AND SPORTS MATERIALS

4.2 USE OF SPACES

a) It will not be possible to make any change in the services and / or spaces that appear in the plan of uses, if it does not have the previous authorization of CEM Marítim
b) Both users and entities outside CEM Marítim They have rented an installation, they must respect the schedules granted and will not be able to use it outside the authorized time.
c) It is not allowed to occupy the spaces where activities are being developed, or to interfere with them. It is also not allowed to occupy free spaces without prior authorization from the centre's managers. The free use of activity rooms and multipurpose rooms is not permitted, unless they are activities directed and / or supervised by technical staff.
d) The distribution of spaces and changing rooms is the responsibility of the entity's management. The criteria, in this case, are based on the rationality and use of space.
e) The specific regulations regarding each space and the maximum capacity provided for each installation must be respected.

4.3 USE OF SPORTS EQUIPMENT

a) With regard to sports equipment that is not from the facility, for reasons of hygiene and safety it may not be used, except for that material supervised by the person in charge of the space.
b) Users are responsible for the sports equipment they use, and must return it to their place once they have used it.
c) Each entity is responsible for the sports equipment it uses. Likewise, the entities must respect the order of the warehouses of the sports equipment and have it ordered and stored in the assigned space.
d) The coach or person responsible for each entity must control the material used for the activities. It will also be responsible that, once the activity has ended, the facilities, equipment and sports spaces used are in a condition to be reused.
e) Any damage caused to the installation or the material due to misuse will be the responsibility of the person who caused it and, in the alternative, of the entity to which it belongs, if this person is using the installation. As a member of a group. The costs of repairs will be borne by the person responsible.

4.4 GENERAL BEHAVIOR GUIDELINES  

a) Users will maintain the cleanliness and order of all facilities, equipment and sports equipment, as well as respectful behavior towards staff and other people present.
b) Care must be taken to ensure that all the elements of the installation and the specific rules of use are respected as much as possible: make good use of the bins, leave the changing rooms in good condition for the people who will come later, etc.
c) The rules and advice of the staff of the sports facility must be respected.
d) In general, no action is permitted that alters public order or the normal and peaceful coexistence of users.
e) For the use of the sports space, users have the obligation to change their street shoes and wear exclusive footwear suitable for sports activities, as well as to wear sports clothes. It will not be possible to do physical activity with street clothes.
f) It is mandatory to always use the changing rooms to change clothes. It is not allowed to do this in any other dependency of the installation.
g) It is advisable not to bring valuables to the facility, as management is not responsible for lost or forgotten items.

4.5 HEALTHY BEHAVIOR GUIDELINES

a) A previous medical check-up is recommended in case you want to start a sports activity. In any case, the user will be solely responsible for any type of incident that may suffer for health reasons, either due to ignorance of a possible illness or due to overexertion during sports.
b) At the time of registering at the center, it is mandatory to answer the Physical Activity Initiation Questionnaire. In the event that one of the questions in the questionnaire is answered in the affirmative, a compulsory medical check-up must be carried out with the institution's doctor. This compulsory medical examination will be free of charge and will serve to guide the new subscriber on the type of activity best suited to their needs.
c) The CEM Marítim puts at the disposal of the users, during all the period of opening of the installations technical personnel that can advise them on the best way to do physical activity.
d) It is recommended to do a proper warm-up before starting the physical activity and at the end of it, do stretching and relaxation exercises to return to calm, before going to the shower. In any case, any type of injury caused by a bad practice will be the sole responsibility of the user.
e) During the sessions, it is advisable to hydrate by drinking small amounts of water often.
f) It is recommended not to eat for two hours before exercising.
g) In the directed sessions, it is necessary to follow the advice of the technical personnel and to consult to him any doubt that can have.

4.6 ORGANIZATION AND PROGRAMMING OF ACTIVITIES

a) The CEM Marítim  will make public, for each space, the schedule of activities scheduled in accordance with the plan of uses, and it will be mandatory to respect it.
b) The CEM Marítim through the management of the center, reserves the right to modify and / or cancel the hours of use of the facilities when circumstances so require. All activities will begin and end according to schedule, and will not be allowed to be extended if, due to any incident, the activity has started later.
c) Access to the guided sessions must be at the indicated time. After 5 minutes from the start of the session, access will not be allowed.
d) It is not allowed, in any case, to carry out private courses or technical advice at a particular level in sports facilities, except for the personal trainer service of the facility.

4.7 LOST OBJECTS AND AVAILABILITY OF CABINETS

a) The CEM Marítim is not responsible for objects deposited in lockers, nor is it responsible for lost or forgotten items in the center.
b) The lost objects that may have been collected will be available to users for 15 days. After this period, the person in charge of the installation will destroy them or donate them to non-governmental organizations.
c) Soaps, body creams, and underwear will not be collected or stored.

4.8 WARDROBES

The use of lockers is a service offered by El CEM Marítim so that the users of the center can store their personal effects while carrying out the physical activity. In no case is it a left-luggage office. There are two types of lockers in the CEM centers Marítim:
Clear cupboards - available to users on a temporary basis, or using a padlock.
a) At the end of the activity or stay at the center, the user must leave the locker free, empty and clean.
b) Every day, at the end of the centre's opening hours, the responsible staff will evacuate the lockers that are not free and the objects that are there will become lost objects. The CEM Marítim will not take care of the broken padlock to release the locker.
c) The padlocks are personal and can be purchased at reception.
d) It is recommended to use a padlock at least 7mm thick.

Rent cabinets - are those who are subscribers can rent for a certain period of time, after paying the corresponding fee, and are for their own use during this period.
General recommendations:
a) The bag, clothes and shoes must be kept in the locker. For hygienic reasons, shoes should be stored protected with a plastic bag.
b) Lockers work with a padlock. Each user subscriber must have their padlock.
c) It is recommended not to leave valuables, because the CEM Marítim You will not be responsible for the content in case of loss or loss.
The CEM Marítim reserves the right to check the contents of all lockers when it deems it appropriate for security reasons of the facilities and other users or when it is presumed, in a justified manner, their misuse.

• Punctuality and quality at the beginning of the directed activities

5.1. FITNESS ROOM

5.2. DIRECTED ACTIVITY ROOMS

IT IS NOT ALLOWED:
a) Access to activities for children under 16 years of age. Users under the age of 16 will only be able to participate in activities aimed at this age group. The quadrant of these activities can be requested at the reception of the center. Users over the age of 16 will have free access to all activities included in the subscription fee. Access the room 5 minutes after the start of the activity or when the maximum capacity has been reached. Each of the activities has a maximum number of places depending on the possibilities of capacity of the room and the teaching quality. k) Hydrate during the time spent playing sports.

* The CEM Marítim reserves the right to modify, change or delete any activity, in case of need of the entity itself or of Barcelona City Council.

5.3. INDOOR / INDOORWALKING CYCLE ROOM
Hours: It can be accessed whenever there is a scheduled activity

IT IS NOT ALLOWED:

IT IS MANDATORY:
a) Ensure their good maintenance and leave them in good condition for future users.
b) Shower in the time strictly necessary and make a responsible consumption of water.
c) Make use of the space inside the shower area to dry, as well as to drain the bathroom equipment.
d) Store all belongings in the closet, even when in the shower area. For your own safety, do not store valuables in the locker.
e) Leave the locker free when leaving the center. Every night they will be emptied to clean them. The objects that are there will go to Customer Service, the owners will have 15 days to collect them.
f) That children under 7 change with their companion and in the same dressing room.
g) It is strictly mandatory to go through the shower tunnel before accessing the water area (swimming pools, relaxation area).

h) Eating or smoking.

e) If the service is canceled before the previous 24 hours, the day and time may be agreed again at no charge. In case of cancellation out of time or not attending, 50% of the service not performed may be reserved again as a subscriber.

Users have the right to:

A) TRAININGS AND COMPETITIONS
All those teams belonging to clubs or entities that have a usage agreement on specific days and times with the CEM Marítim.

B) SUBSCRIBERS
Subscribers over the age of 16 and accompanied minors will be able to use these spaces individually to play basketball, volleyball, badminton and table tennis with the available times published on the schedule of activities and on the website, which can be modified by the needs of the entity.

5.10. GRADES

Spectators, as well as companions, will only be able to access the assigned spaces. The CEM Marítim "is not responsible for lost or forgotten items in the facility. Lost items will be kept on receipt at the facility for a period of 15 days; after this time they will be delivered to charities or organizations.

6. NON-COMPLIANCE WITH REGULATIONS AND SANCTIONS

6.1. Minor breaches:

a) Failure to comply with the conditions set out in the Regulations relating to the proper use of the facilities, furniture, etc., when they do not cause damage to them, which do not represent ill-treatment, or lack of respect for people, or impersonation of other people.
b) Failure to comply with the use plan and / or operating hours of the facilities.

6.2. Serious breaches:

a) Failure to comply with the conditions set out in the Regulations relating to sports facilities, the proper use of facilities, furniture, etc., when they cause damage to them.
b) Uncivil behavior towards other users and / or staff who provide services to the facilities.
c) Refuse to leave the installation, when required by the staff, for not having complied with the regulations and in the event of an emergency and / or simulation.
d) Use the installation, individually, for purposes other than those for which the authorization has been granted.
e) Failure to comply with the plan of uses and / or the operating hours of the facilities when it affects other users or the service.
f) Use the facilities by a group with different people and / or activities other than those listed in the relationship between the people in charge of the center.
g) Access to the facilities without authorization or with the accreditation of another person.

6.3. Very serious breaches

c) Use the sports facilities for purposes other than sports, without the corresponding authorization.
d) Carry out activities prohibited in these Regulations when these are likely to generate an economic return.
e) Non-compliance when they cause serious damage to the facilities, serious damage to other users or seriously disrupt the operation of the services.
f) Recidivism of serious breaches will be considered very serious breaches.

6.4. Measures to be applied for non-compliance with the conditions of use, competence in their application and prescription.

a) Minor non-compliances: written communication, temporary expulsion from the facilities for a period of one day to one month.
b) Serious breaches: written communication, suspension of the right of entry to the facilities for a period of one month to one year.
c) Very serious breaches: suspension of the condition of user, for a period of one year up to five years or definitive, as well as to compensate the economic damages that it generates in the installation.

2 - The expulsion of the facilities, or any other measure aimed at ensuring security and order in the Service, may be agreed by any of the heads of the centers or by any worker of the facilities in case of absence of these, without prejudice to being able to propose to the director of the center the adoption of the other measures foreseen in this article. The expulsion of the facilities will be immediate and its duration will affect the rest of the day in which the fact that motivates the application of this measure occurs.  
3 - The suspension of the right to entry to the installations may be agreed upon by the director, in the first instance, in the event of not complying with the conditions of use set forth in sections b) and c) of the previous article , and later by the Equipment Council, in second instance.
4 - The director of the center will decide to impose some of the measures mentioned above, having seen the previous report of the workers and coordinator of the area. The affected person will have the possibility to allege the arguments that he / she considers appropriate and to provide evidence in his / her defense in the previous hearing that is done to him / her, without prejudice to other actions and diligences that he / she deems opportune. An ordinary appeal may be lodged against the decision of the director of the center before the manager or the Board of Directors of CEM. Marítim.
5 - The duration of the applicable measure will be determined, in accordance with the principle of proportionality, taking into account the intentionality in the action of the interested party, the nature of the damages caused, the repetition and the recidivism.  
6 - The director of the center may arbitrate the necessary precautionary measures to ensure compliance with the conditions of use of the facility, without prejudice to the competence of the coordinators and, in any case, must be confirmed by him.
7 - The measures provided for in this article will be applied without prejudice to the corresponding disciplinary, civil or criminal actions in accordance with current legislation.
8 - Barcelona City Council and the CEM board Marítim  will be informed of the sanctions imposed on potential violators of the rules of use.

6.5. Responsibilities

They will be directly responsible for the infractions to this Regulation:
a. The material perpetrators of the infractions, either by action or omission, except in cases that are underage or that there is a legal cause of imputability in them. In this case, the parents, guardians, guardians or those who have custody or legal custody will be responsible.
b. The entities or persons responsible for the user, when the offender carries out the activity as part of a group, will also be responsible for the infractions that that person commits.
c. Persons holding authorizations or licenses, when, on the occasion of the exercise of a right granted to them, they commit one of the infringements specified in these Regulations.

The declaration of liability for infringement and the application of the corresponding measure will not, in any case, avoid the obligation to compensate for the damages caused.  

6.6. Warranties and terms

a) Sanctions may not be imposed without the prior instruction of a file.
b) The Technical Commission for the Management of the Equipment is the competent body to initiate the file ex officio or at the request of any party; to this end, it will listen to and draw up a report detailing the case and the resolution of the case, within a maximum period of 10 days.
c) Exceptionally and when they are necessary to guarantee the normal development of the activities or in the event that serious damages can be deduced from them, as a precautionary measure, when initiating a sanctioning procedure or at any time during the investigation, the Commission Management Technique may agree to the suspension of attendance at training or matches or access to the facilities for a period not exceeding that of the resolution of the case.
d) The Technical Management Committee will initiate the actions it deems pertinent in order to draw up the list of charges or the proposal for dismissal and, with the prior hearing of the accused and in the case of parents or legal representatives coach provided that these are minors, who may present the allegations, justifications and evidence they deem relevant.
e) The resolution of the file must take place within a maximum period of one month from the date of its commencement. Unless justified causes determined by the complexity of the instruction so require. It will then be ratified by the Monitoring / Equipment Commission.
f) The notification of the resolutions to the interested parties will be made in writing by hand or by certified mail or e-mail.
g) An optional appeal for reversal may be lodged against this decision within a period of fifteen days before the same body that issued it or, directly, an appeal, which exhausts the administrative route, before the competent Department. With the warning that against the resolution of this last appeal it only remains to present an administrative contentious appeal before the Administrative Contentious Courts within a period of two months, both to be counted from the day after the receipt of its notification.
